Kyle Sandilands Takes Fight Against ARN to Federal Court

Radio personality Kyle Sandilands is set to take his dispute with Australian Radio Network (ARN) to court, with legal proceedings commencing imminently. The move follows Sandilands’ recent axing from ARN, and the first case management hearing is scheduled for March 27th at 9 am.

Sources reveal that a crucial document filed in the Federal Court of Australia is an affidavit from Sandilands, whose full name is Kyle Dalton Sandilands. An affidavit is a sworn written statement used as evidence in legal proceedings.

On Thursday, Ben Fordham, host of Sydney’s 2GB radio show, disclosed details about the upcoming court case. He shared information obtained from a screenshot of court documents, indicating that Sandilands will be initiating legal action against ARN.

“Looks like it’s going to start tomorrow,” Fordham reported on his show. “Our entertainment editor Peter Ford has sent me a copy of a screenshot from the Commonwealth Courts. And it says here, 27 March, 9am, first case management hearing before Justice Stewart.”

The court documents, as detailed by Fordham, include filings such as a Notice of Acting, Appointment of Lawyer for Australian Radio Network (ARN), and originating applications and concise statements from Kyle Dalton Sandilands. This signals a significant legal battle is about to unfold.

The “Dump Button Defence” Strategy

A key element of Sandilands’ legal strategy, according to Fordham, will be the “dump button defence.” This defence hinges on the radio broadcast delay system and the role of censors.

“2GB Breakfast can reveal Kyle Sandilands is going to use the dump button defence,” Fordham stated. He explained the mechanics of the delayed broadcast on The Kyle and Jackie O Show, which featured a 30-second delay. During this delay, a censor, employed by the radio network and operating independently of the show’s hosts, was tasked with monitoring conversations. If discussions veered into potentially problematic territory, the censor would activate a “dump button” to bleep out any content deemed too risky.

Fordham highlighted a critical point regarding an on-air argument between Sandilands and Jackie Henderson. He pointed out that on the morning of this particular incident, the censor apparently did not intervene.

“It’s my understanding that it’s written into Kyle’s contract that the radio station is responsible for what goes to air,” Fordham elaborated. “The radio station is actually obliged to dump anything that breaches the signed agreement between ARN and Kyle. So, if anything being broadcast placed Kyle in breach of his contract, the radio network had a duty to dump it.”

Allegations of Contractual Breach and Unfair Dismissal

Sandilands himself has previously released a statement expressing his disagreement with ARN’s decision to terminate his contract. He claimed that his lawyers had advised ARN last week that the termination would be invalid, and he believes this to be the case.

“ARN has just announced that they’ve terminated my contract. I don’t accept it,” Sandilands stated. “My lawyers told them last week this would be invalid. And guess what? It is.”

He recounted an on-air disagreement with Jackie O, describing it as a typical “blue” that they had experienced numerous times over their 25-year partnership. Sandilands alleges that ARN used this incident as a pretext to terminate his contract.

“Let me tell you what actually happened here. Jackie and I had a blue on air. That’s it. The kind of thing we’ve done a hundred times in 25 years. And ARN took the situation and decided to try and burn the place down,” Sandilands asserted.

He further detailed the events that followed the on-air clash: “They sacked Jackie. They suspended me. They wouldn’t even let me pick up the phone to call her or anyone else on the show. Then – and this is the bit that gets me – once they’d made it impossible for the show to go on, they turn around and say, ‘You didn’t fix it. You’re fired!'”

Sandilands contends that ARN did not genuinely attempt to resolve the situation but instead saw an opportunity to exit a contract signed just a year prior.

“They didn’t want to fix this. They thought they saw a chance to get out of the contract they signed with me a year ago, and they ran with it,” he added.

ARN’s Official Statement

ARN Media Limited issued a statement to the ASX regarding the termination. “ARN Media Limited advises that it has issued a notice of termination of contract to Mr Kyle Sandilands and Quasar Media Services Pty Ltd (Quasar Media),” the statement read. “As a result, the Kyle and Jackie O show will no longer be presented.”

The company’s decision was attributed to a previous ASX announcement on March 3, 2026, which indicated that ARN had provided written notice to Sandilands and Quasar Media. ARN stated that it considered Sandilands’ behaviour during the broadcast on February 20, 2026, to constitute serious misconduct and a breach of ARN’s services agreement with Quasar Media. As per the announcement, Sandilands was given 14 days to remedy the alleged breach.

The on-air clash that led to Sandilands’ suspension and subsequent termination reportedly occurred after Jackie Henderson, 51, read from an astrology birth chart. Henderson has also broken her silence, stating in a public statement that she “did not quit or resign” from The Kyle and Jackie O Show. She indicated that she was addressing the matter through appropriate legal channels.

Sandilands maintains he has a contract until 2034 and believes ARN has failed to honour its contractual obligations. “I’ve got a contract until 2034. I’ve got rights under that contract. And ARN hasn’t honoured the contract. So, it’s over to my lawyers,” he concluded.
