‘Dismissive and callous’: Dua Lipa takes Samsung to court over image misuse

Dua Lipa Files Lawsuit Against Samsung Over Unauthorized Use of Her Image

Pop star Dua Lipa has taken legal action against tech giant Samsung, accusing the company of using her image without permission to promote their TVs. The lawsuit, filed late last week, claims that Samsung used a copyrighted backstage photo of Lipa on TV packaging sold in the United States.

Lipa, 30, is seeking $15 million (approximately $21 million) in damages and a share of profits from the product sales. According to the complaint, her likeness was used in a mass marketing campaign for a consumer product without her knowledge or consent. The filing states that she had no say, control, or input regarding the use of her image.

“Ms. Lipa’s face was prominently used for a mass marketing campaign for a consumer product without her knowledge, without consideration, and as to which she had no say, control, or input whatsoever,” the lawsuit said. “Ms. Lipa did not allow and would not have allowed this use.”

The complaint further alleges that the use of her image falsely implied her endorsement of the product. It claims that the image contributed significantly to sales by giving fans the impression that she was affiliated with the brand and “inducing potential consumers to buy [the product] because it featured Ms. Lipa.”

Social Media Reactions Highlight Fan Response

In the filing, Lipa cited social media discussions that showed fans’ reactions to the product. A photo of the TV box featuring her likeness was posted on an Instagram fan account with the caption “DUA IN THE WILD!! Spotted in Miami on the Samsung Tv box.” One fan commented, “I wasn’t even planning on buying a TV but I saw the box so I decided to get it.” Another fan wrote, “I’d get that TV just because Dua is on it.”

The lawsuit also claims that Samsung refused to comply with repeated cease and desist demands from Lipa, describing the company’s response as “dismissive and callous.” It states that the infringing products remain on the market, still being sold throughout the country in ongoing acts of willful infringement.

“Samsung’s arrogance in refusing to stop its infringement confirms its conscious disregard of Ms. Lipa’s intellectual property and personal identity rights,” the filing said.

The Image at the Center of the Dispute

The image at the center of the dispute is titled “Dua Lipa – Backstage at Austin City Limits, 2024,” and is currently registered with the U.S. Copyright Office. The lawsuit highlights the unauthorized use of this image, which was taken during a private event and not intended for commercial purposes.

Legal Implications and Public Reaction

This case raises important questions about the use of celebrities’ likenesses in advertising and marketing. While companies often rely on popular figures to boost sales, the unauthorized use of images can lead to significant legal consequences. Lipa’s case underscores the need for clear consent and compensation when a person’s image is used for commercial gain.

Public reaction to the lawsuit has been mixed. Some fans support Lipa’s decision to take legal action, arguing that her image should not be used without her approval. Others are surprised by the extent of the issue, questioning how such a high-profile image could be used without permission.

As the case moves forward, it will be interesting to see how the court rules on the matter and what precedent it sets for future cases involving celebrity likenesses and intellectual property rights.
